However, some insurance companies are not honest in their dealings with clients. They may deny your claims or delay them unnecessarily. They may justify these with paperwork errors or do so because of bad management. Either way, you have a right to the coverage agreed upon in your <b><a href="https://en.wikipedia.org/wiki/Insurance" style="color: #cc6611; text-decoration-line: none;" target="_blank">insurance</a></b> contract.</div></span><div style="font-size: 13.2px;"><span style="color: #404040; font-family: "Helvetica Neue", Helvetica, Arial, sans-serif; font-size: 13px;"><br /></span></div><span style="color: #404040; font-family: "Helvetica Neue", Helvetica, Arial, sans-serif; font-size: 13px; text-align: start;"><div style="text-align: justify;">Your insurance contract may provide full coverage for all costs and repairs involved in a car accident. You could also have uninsured and underinsured cover entitling you to compensation in an accident where the other driver is at fault but has no cover or insufficient cover. The maximum amount of cover you qualify for depends on the plan you chose. However, insurers should meet their obligation in case of an accident where you do qualify for compensation.</div></span><div style="font-size: 13.2px;"><span style="color: #404040; font-family: "Helvetica Neue", Helvetica, Arial, sans-serif; font-size: 13px;"><br /></span></div><span style="color: #404040; font-family: "Helvetica Neue", Helvetica, Arial, sans-serif; font-size: 13px; text-align: start;"><div style="text-align: justify;">An additional claim that Maryland drivers can make is diminished value claims for the reduced value of their cars after an accident. This is available to drivers who are not at fault for accidents. If, after an accident, your insurance company treats you unfairly, refusing to honor its end of the insurance contract, you can sue it in bad faith tort claim or for contract violation. Consult a personal injury attorney for guidance.</div></span></div></div>Rick Jaklitschhttp://www.blogger.com/profile/08105099654401188539noreply@blogger.com0tag:blogger.com,1999:blog-5287464842119421425.post-89156120541183478592021-03-02T20:32:00.002-08:002021-03-02T20:32:10.945-08:00Rideshare Drivers Insurance Policy Structure<div class="modal-body" style="padding: 15px;"><div id="md-content"><div style="color: #404040; font-family: "Helvetica Neue", Helvetica, Arial, sans-serif; font-size: 13px; text-align: justify;"><div class="separator" style="clear: both; text-align: center;"><a href="https://lh3.googleusercontent.com/-e2d48V4ijUo/YD8RQ4NZtoI/AAAAAAAAAH0/OIFCtf13poY83QbPL-BAqSySswmVHgytQCNcBGAsYHQ/image.png" style="margin-left: 1em; margin-right: 1em;"><img alt="" data-original-height="417" data-original-width="626" height="213" src="https://lh3.googleusercontent.com/-e2d48V4ijUo/YD8RQ4NZtoI/AAAAAAAAAH0/OIFCtf13poY83QbPL-BAqSySswmVHgytQCNcBGAsYHQ/image.png" width="320" /></a></div><br /><br /></div><div style="color: #404040; font-family: "Helvetica Neue", Helvetica, Arial, sans-serif; font-size: 13px; text-align: justify;">As the owner of the personal injury law firm, The <b><a href="https://medium.com/@Jaklitsch" target="_blank">Jaklitsch</a></b> Law Group, experienced attorney Rick Jaklitsch stays informed on the latest developments impacting liability and insurance law. This is because traditional car insurance does not cover incidents related to the commercial use of a vehicle. To better protect riders, major <b><a href="https://en.wikipedia.org/wiki/Ridesharing_company" target="_blank">rideshare firms</a></b> began offering policies to their drivers. However, these plans also have limitations. Coverage is categorized into four different situations. No additional coverage is provided when the driver is not logged into the app.</div></span><div style="text-align: justify;"><br /></div><span style="color: #404040; font-family: "Helvetica Neue", Helvetica, Arial, sans-serif; font-size: 13px;"><div style="text-align: justify;">Logged-in drivers who are awaiting a ride request are also not covered. Once the driver has received a job, the rideshare insurance policy kicks in. If a driver causes a collision during this period, some of the compensation may derive from the rideshare policy. In the final scenario, the rideshare passenger and any other individuals impacted by an accident will be covered by the driver’s rideshare insurance.</div></span></div></div><div class="modal-footer" style="background-color: whitesmoke; border-radius: 0px 0px 6px 6px; border-top: 1px solid rgb(221, 221, 221); box-shadow: rgb(255, 255, 255) 0px 1px 0px inset; color: #404040; font-family: "Helvetica Neue", Helvetica, Arial, sans-serif; font-size: 13px; margin-bottom: 0px; padding: 14px 15px 15px; zoom: 1;"></div><p> </p>Rick Jaklitschhttp://www.blogger.com/profile/08105099654401188539noreply@blogger.com0tag:blogger.com,1999:blog-5287464842119421425.post-42432052357504884492021-02-10T21:19:00.001-08:002021-02-10T21:19:18.335-08:00Distracted Driving Goes Beyond Cell<p style="text-align: justify;"></p><div class="separator" style="clear: both; text-align: center;"><a href="https://1.bp.blogspot.com/-v_ddt2G_qh0/YCS-Nur6IiI/AAAAAAAAAHk/atlTAEeNAuEXfTzBW4F6zsIr4lwUEythgCNcBGAsYHQ/s2048/Distracted%2Bdriving.jpg" imageanchor="1" style="margin-left: 1em; margin-right: 1em;"><img border="0" data-original-height="1365" data-original-width="2048" src="https://1.bp.blogspot.com/-v_ddt2G_qh0/YCS-Nur6IiI/AAAAAAAAAHk/atlTAEeNAuEXfTzBW4F6zsIr4lwUEythgCNcBGAsYHQ/s320/Distracted%2Bdriving.jpg" width="320" /></a></div><span style="background-color: white; color: #404040; font-family: "Helvetica Neue", Helvetica, Arial, sans-serif; font-size: 13px;"><p style="text-align: justify;">A Maryland-based attorney, <b style="background-color: transparent;"><a href="https://www.cakeresume.com/rick-jaklitsch" target="_blank">Rick Jaklitsch</a></b> has spent more than two decades leading the Jaklitsch Law Group. Over the past few decades, these collisions have fortunately declined from 9,400 collisions in 1981 to around 2,200 in 2018. This has been thanks to public service announcements that warn drivers of the dangers of cross tracks when a train is there, along with technology upgrades on trains that notify conductors and engineers of upcoming crossings. Some trains even have automatic stop technology incorporated.</div></span><div style="text-align: justify;"><span style="color: #404040; font-family: "Helvetica Neue", Helvetica, Arial, sans-serif; font-size: 13px;"><br /></span></div><span style="background-color: white; color: #404040; font-family: "Helvetica Neue", Helvetica, Arial, sans-serif; font-size: 13px;"><div style="text-align: justify;">Unfortunately, this has not eliminated collisions between trains and passenger vehicles. Such accidents may occur in areas that lack upgraded technology. Or they happen with safety equipment fails, there isn’t visible road signage, and the train tracks aren’t cared for. Regardless of the reason, these accidents are the fault of either the drive or railway company, depending on the circumstances.</div></span><div style="text-align: justify;"><span style="color: #404040; font-family: "Helvetica Neue", Helvetica, Arial, sans-serif; font-size: 13px;"><br /></span></div><span style="background-color: white; color: #404040; font-family: "Helvetica Neue", Helvetica, Arial, sans-serif; font-size: 13px;"><div style="text-align: justify;">The railway company is usually at fault when accidents result from the conductor not operating the train correctly. They are also at fault, or a state or local agency is when the accident was caused by poor maintenance of the rail lines or lack of appropriate signage at the crossing. Meanwhile, drivers are at fault if they ignored the signage or if they pushed another vehicle onto the tracks from behind.</div></span>Rick Jaklitschhttp://www.blogger.com/profile/08105099654401188539noreply@blogger.com0tag:blogger.com,1999:blog-5287464842119421425.post-788356170768680752021-01-26T13:24:00.003-08:002021-01-26T13:26:10.623-08:00MSBA and Maryland Chamber of Commerce<p style="text-align: justify;"></p><div class="separator" style="clear: both; text-align: center;"><a href="https://1.bp.blogspot.com/-ZwR-4cdVpVk/YBCIan1DzpI/AAAAAAAAAG8/AYtUNKmzHg4G-r8VMW1vE0AXalQT99ccwCNcBGAsYHQ/s2048/Maryland%2BState%2BBar%2BAssociation.jpg" imageanchor="1" style="margin-left: 1em; margin-right: 1em;"><img border="0" data-original-height="1365" data-original-width="2048" src="https://1.bp.blogspot.com/-ZwR-4cdVpVk/YBCIan1DzpI/AAAAAAAAAG8/AYtUNKmzHg4G-r8VMW1vE0AXalQT99ccwCNcBGAsYHQ/s320/Maryland%2BState%2BBar%2BAssociation.jpg" width="320" /></a></div><span style="background-color: white; color: #404040; font-family: "Helvetica Neue", Helvetica, Arial, sans-serif; font-size: 13px;"><br /></span><p></p><p style="text-align: justify;"><span style="background-color: white; color: #404040; font-family: "Helvetica Neue", Helvetica, Arial, sans-serif; font-size: 13px;">Personal injury Attorney <b><a href="https://about.me/RickJaklitsch" target="_blank">Rick Jaklitsch</a></b> is head of the nationally-acclaimed law firm The Jaklitsch Law Group in Upper Marlboro, Maryland. Rick Jaklitsch’s group addresses insurance in the blog article, “When the Stubborn Insurance Company Is Your Own.”<br /><br />When accidents occur, many drivers assume that their full coverage means the <b><a href="https://en.wikipedia.org/wiki/Insurance">insurance </a></b>company will pay promptly. Unfortunately, this is not always the case. Insurance companies sometimes deny or delay legitimate claims. Among many awards, Rick Jaklitsch was recently selected for the Super Lawyers list in 2020 in his home state of Maryland.<br /><br />The selection process for inclusion on the Super <b><a href="https://en.wikipedia.org/wiki/Lawyer">Lawyers </a></b>list involves four steps. The first three focus on identifying and thoroughly vetting the nominees to the list. The organization invites lawyers from each state to nominate the top attorneys in their area for the selection process. These are complemented by informal nominations from clients, readers, and other members of the community who are not otherwise eligible to nominate candidates.<br /><br />Then, the Super Lawyers staff evaluates each lawyer on 12 indicators of achievement. Some indicators are more heavily weighted than others to ensure a fair evaluation. The final step groups nominees into one of four firm categories, so lawyers are compared to peers working in similarly sized firms.<br /><br />Afterward, the staff investigates each nominee’s standing with local authorities and for the presence of any disciplinary activity in the past. They also contact each lawyer directly to verify the accuracy of the information discovered about them. Ultimately, no more than 5 percent of the lawyers in the state are selected for the list, which is published in regional editions of Super Lawyers Magazine.</div></div><div class="modal-footer" style="background-color: whitesmoke; border-radius: 0px 0px 6px 6px; border-top: 1px solid rgb(221, 221, 221); box-shadow: rgb(255, 255, 255) 0px 1px 0px inset; color: #404040; font-family: "Helvetica Neue", Helvetica, Arial, sans-serif; font-size: 13px; margin-bottom: 0px; padding: 14px 15px 15px; zoom: 1;"></div><p> </p>Rick Jaklitschhttp://www.blogger.com/profile/08105099654401188539noreply@blogger.com0tag:blogger.com,1999:blog-5287464842119421425.post-29329361394523016292020-05-12T05:55:00.001-07:002020-05-12T05:55:36.656-07:00How to Get Nominated for Super Lawyers<div dir="ltr" style="text-align: left;" trbidi="on">
<br />
<div style="text-align: center;">
<img alt="178825182" height="252" src="https://t4.ftcdn.net/jpg/01/78/82/51/240_F_178825182_MFSNHolbFqtYfSvdaQHLFP7DdusM8pjL.jpg" style="text-align: left;" width="400" /></div>
<div style="text-align: center;">
<span style="background-color: white; color: #404040; font-family: "Helvetica Neue", Helvetica, Arial, sans-serif; font-size: 13px;"><br /></span></div>
<div style="text-align: justify;">
<span style="background-color: white; color: #404040; font-family: "Helvetica Neue", Helvetica, Arial, sans-serif; font-size: 13px;">The owner of the Jaklitsch Law Group, <a href="https://about.me/RickJaklitsch" target="_blank">Rick Jaklitsch</a> has extensive experience in personal injury law and was recently recognized for his work. In addition to being awarded as American Lawyer Magazine’s Top Rated Personal Injury Attorney 2019 and National Law Journal’s 2019 Top Personal Injury Attorney, Rick Jaklitsch was also nominated for Maryland’s Super Lawyers' list for 2020.</span></div>
<div style="text-align: justify;">
<span style="color: #404040; font-family: "Helvetica Neue", Helvetica, Arial, sans-serif; font-size: 13px;"><br /></span></div>
<span style="background-color: white; color: #404040; font-family: "Helvetica Neue", Helvetica, Arial, sans-serif; font-size: 13px;"><div style="text-align: justify;">
The list is comprised of top-performing lawyers in the state. The selection is based on 12 indicators, relating to experience, research and publications, community service, settlements and verdicts, and other factors. Because the selection is also based on peer <a href="https://en.wikipedia.org/wiki/Nomination" target="_blank">nominations</a>, networking and community service are advantageous to the attorney. By developing a network of attorneys practicing in similar areas, the person seeking nomination improves their chances of being selected for the list simply through heightening their profile. Plus, community service can fill in gaps in areas where a person is not as accomplished.</div>
</span><div style="text-align: justify;">
<span style="color: #404040; font-family: "Helvetica Neue", Helvetica, Arial, sans-serif; font-size: 13px;"><br /></span></div>
<span style="background-color: white; color: #404040; font-family: "Helvetica Neue", Helvetica, Arial, sans-serif; font-size: 13px;"><div style="text-align: justify;">
The program also accepts informal nominations from professionals who can attest to the candidate’s abilities but cannot make a formal nomination-for whatever reason. While informal nominations do not hold the same weight as formal ones, they can serve to highlight the breadth of the candidate’s experience. Getting informal nominations from actively licensed attorneys can improve a candidate's chances of being selected.</div>
</span><div style="text-align: justify;">
<span style="color: #404040; font-family: "Helvetica Neue", Helvetica, Arial, sans-serif; font-size: 13px;"><br /></span></div>
<span style="background-color: white; color: #404040; font-family: "Helvetica Neue", Helvetica, Arial, sans-serif; font-size: 13px;"><div style="text-align: justify;">
Having articles published or being involved in legal research is another highly-valued accomplishment. Legal writings, lectures, and professional reviews are all outlets that can provide selection committees with insight into the candidate’s views and opinions.</div>
</span><div style="text-align: justify;">
<span style="color: #404040; font-family: "Helvetica Neue", Helvetica, Arial, sans-serif; font-size: 13px;"><br /></span></div>
<span style="background-color: white; color: #404040; font-family: "Helvetica Neue", Helvetica, Arial, sans-serif; font-size: 13px;"><div style="text-align: justify;">
Certifications, finally, establish a person’s commitment to the legal field. More importantly, these certifications attest to the person’s desire to keep learning through continuing education and other professional development.</div>

Personal injury attorney <a href="https://jaklitsch.wordpress.com/" target="_blank">Rick Jaklitsch</a> has received an AV Preeminent rating from Martindale-Hubbell for more than 25 years. Throughout his career as an attorney, Rick Jaklitsch has helped thousands of people in cases from million-dollar-plus payouts to as little as $23 in unpaid <a href="https://en.wikipedia.org/wiki/Personal_injury_protection" target="_blank">personal injury protection</a>.<br /><br />In a personal injury case, it’s often the duty of the plaintiff to prove negligence as it is understood in legal terms. This starts with showing that the defendant had a duty of care, or obligation, to avoid injuring someone placed in the plaintiff’s position.<br /><br />Once that’s established, it’s necessary to show that the duty of care was breached in some way. It’s one thing to show that someone has an obligation - it must then be shown the duty was not met.<br /><br />Last, the plaintiff has to prove causation. That is to say, beyond showing that there was a duty and the duty was not met, it must be proven that negligence was the proximate cause of the plaintiff’s injuries. This is the general way that many personal injury cases proceed, but it’s not the only way, and it ultimately depends on the specifics of a case and the strategy of the attorney.</div>

Seen as the gold standard in attorney ratings, Martindale-Hubbell ratings help individuals searching for lawyers to fulfill their legal needs by granting them the ability to identify and evaluate attorneys based on various factors. The organization has been providing peer review ratings for more than 100 years, during which time it has perfected its methodology.</span><br style="background-color: white; color: #404040; font-family: "Helvetica Neue", Helvetica, Arial, sans-serif; font-size: 13px;" /><br style="background-color: white; color: #404040; font-family: "Helvetica Neue", Helvetica, Arial, sans-serif; font-size: 13px;" /><span style="background-color: white; color: #404040; font-family: "Helvetica Neue", Helvetica, Arial, sans-serif; font-size: 13px;">To create its ratings, Martindale-Hubbell administers anonymous online surveys. These surveys are made available to attorneys practicing in various geographic locations and jurisdictions and ask respondents to assess the ethical standards and legal ability of their colleagues. Each attorney is rated on a scale of one to five in five different categories: analytical capabilities, judgment, legal knowledge, legal experience and communication ability. On this rating scale, one (1) is the lowest-possible score.</span><br style="background-color: white; color: #404040; font-family: "Helvetica Neue", Helvetica, Arial, sans-serif; font-size: 13px;" /><br style="background-color: white; color: #404040; font-family: "Helvetica Neue", Helvetica, Arial, sans-serif; font-size: 13px;" /><span style="background-color: white; color: #404040; font-family: "Helvetica Neue", Helvetica, Arial, sans-serif; font-size: 13px;">Based on these ratings, Martindale-Hubbell assigns different ratings to attorneys. Notable attorneys are recognized by their peers as having strong ethical standards. Meanwhile, distinguished professionals have some legal experience, high professional achievement and high ethical standards. The highest peer rating possible is AV Preeminent. Martindale-Hubbell reserves this rating for attorneys that are ranked at the highest level of excellence for their communication, ethics and knowledge by a large number of their peers.</span>Rick Jaklitschhttp://www.blogger.com/profile/08105099654401188539noreply@blogger.com0tag:blogger.com,1999:blog-5287464842119421425.post-58278792454121289972019-09-25T20:29:00.001-07:002019-09-25T20:29:44.429-07:00Maryland Legislature Discusses Vulnerable Road User Act<div class="modal-body" style="color: #404040; font-family: "Helvetica Neue", Helvetica, Arial, sans-serif; font-size: 13px; padding: 15px;">

Respected personal injury lawyer <a href="http://www.rickjaklitsch.com/">Rick Jaklitsch</a> has appeared multiple times on prestigious Top Lawyer lists published by the National Trial Lawyers Association and the American Trial Lawyers Association. Rick Jaklitsch has successfully represented Maryland-based clients injured through no fault of their own in accidents caused by motorists.<br /><br />In an effort to provide extra protection for bicyclists, pedestrians, and other individuals deemed vulnerable road users, Maryland lawmakers have introduced a bill to increase penalties for motorists involved in accidents with this population.<br /><br />Currently, unless a driver has been grossly negligent, the consequences for striking a vulnerable road user could be as minor as a traffic fine. If passed, the bill would require offenders to pay up to $2,000 and appear before a judge. Further, motorists found guilty may lose their license and be required to complete community service.<br /><br />While the bill has passed the <a href="https://en.wikipedia.org/wiki/Maryland_House_of_Delegates">Maryland House of Delegates</a>, further discussions are postponed until a future, undetermined date. Advocates believe that tougher laws will reduce the number of fatal incidents involving vulnerable road users.</div>
